Defending Free Expression Online in Florida
Woodhull Freedom Foundation joined American Civil Liberties Union, American Civil Liberties Union of Florida, Electronic Frontier Foundation, Freedom to Read Foundation, LGBT Tech, and Wikimedia Foundation in an amicus brief in CCIA v. Uthmeier, urging the Eleventh Circuit to affirm the injunction against Florida’s HB 3, a law that bans most minors from social media and effectively forces age-verification for everyone. The brief explains that social media is a core venue for protected speech for both youth and adults; HB 3 censors lawful expression, erases online anonymity, and exposes users to privacy and security risks. Because the law regulates fully protected speech (far beyond “harmful-to-minors” content), it cannot survive First Amendment scrutiny. Courts have repeatedly rejected similar restrictions, and this law is both overinclusive and underinclusive in ways the Supreme Court has condemned.
Our mission is to defend sexual freedom and free expression—including online. HB 3 would chill access to vital information, advocacy, and community, while disproportionately harming people discussing sexuality, gender, health, and other sensitive topics. It would also burden adults’ rights in the name of “protecting” minors, contrary to the Constitution.
