Sexual Freedom & Freedom of Speech

May 14, 2025

We at the Woodhull Freedom Foundation firmly believe that sexual freedom requires freedom of speech. Texas’s war on abortion is a prime (and devastating) example of just how interconnected these freedoms are.

Senate Bill 2880 seeks to prevent the sale and distribution of abortion pills – clearly, an attack on reproductive justice. But to effectuate its goal, S.B. 2880 is not just restricting access to the pills themselves (which by itself is objectionable); it is also restricting access to information about the pills. If S.B. 2880 becomes law, it will be illegal in Texas to “provide information” on how to obtain an abortion-inducing drug.

You may be thinking, “provide information” sounds very broad. And it is. As the Electronic Frontier Foundation (EFF) explains, a wide range of speech would fall subject to S.B. 2880. From exchanging emails about seeking an abortion to creating a website that shares information about legal abortion services in other states, you could violate the bill and be subject to civil and criminal liability.

Violations would be enforced by average citizens, who under S.B. 2880 could sue anyone – individuals and “interactive computer services” alike – who don’t comply with the bill’s provisions. Sounds familiar? This bill’s enforcement is similar to the vigilante system Texas lawmakers have imposed to ban abortion.

We are horrified. We urge you to take action by signing this petition to stop S.B. 2880 and contacting to Senator José Menéndez to voice your concerns.
