Reproductive Justice Victory in Wyoming

When we write about the state of reproductive justice in the United States, we don’t often write with good news. Seemingly every week, there is a new, draconian threat to our fundamental human rights. But last month in Wyoming, Judge Thomas T. C. Campbell provided us with some hope.

In his ruling on June 12, Judge Campbell struck down three anti-abortion laws: a law that required a mandatory ultrasound and 48-hour waiting period for people seeking abortions; a law that set forth stringent regulations for abortion clinics; and a law that excluded the use of abortion pills for off-label uses. Each of these laws is incredibly problematic. Forcing people to undergo an ultrasound and wait before an abortion is unnecessarily intrusive as well as emotionally and physically harmful. Forcing abortion clinics to comply with regulations that treat them as surgical centers (which they are not) is overly burdensome. And forcing providers to forgo prescribing abortion pills for off-label uses needlessly limits people’s access to safe medical treatment. Misoprostol, used in combination with Mifepristone, is actually FDA-approved for treating stomach ulcers, but is used off-label to aid medication abortions. (Mifepristone alone stops a pregnancy from growing. Misoprostol assists in the emptying of the uterus.)

In his ruling, Judge Campbell outlines why he was unconvinced by the state’s arguments. As to the first law, he found that the state “offered no cogent evidence illustrating that a waiting period is necessary for any purpose.” As to the second law, he found that the state “again provides no evidence or a causal link of how a surgical abortion facility, operating outside the regulatory framework of an [ambulatory surgical center], negatively impacts women’s health and welfare.” And finally, as to the third law, he found that there is not evidence supporting a need for doctors to be discouraged from prescribing common abortion medications. Ultimately, Judge Campbell found that each of these laws violated the Wyoming Constitution, which protects individuals’ rights to make their own healthcare decisions.
